Legal Question in Workers Comp in Iowa

Workman's Comp. Questions

My husband was injured in '07. He's about to be released from his surgeon's care with permenant disabilities and limitiations on his right shoulder and neck. Our lawyer does not communicate well w/ us and has yet to file suit against the homeowner. Should this have been done already? We hired him last November. What is next for my husband? Should we get a new lawyer?

Your heading is that this is a workers� compensation question but the body of the question asks about a premise liability case, i.e., suing the homeowner. These are two very different cases with very different statutes of limitations. Without knowing the exact type of case along with the date of injury it's difficult to know if the statute of limitations has run or is about to run. That is of course bothersome to any good personal injury lawyer. I suggest if you haven't already done so, to ask your lawyer this question. If he�s not willing to discuss it with you then you seek a second opinion and consider firing the first lawyer.
