Legal Question in Real Estate Law in Ireland

real estate inheritance

My cousin has a life estate on my aunt's country home in Ireland. Upon his death it passes to me. He cannot ever sell the property without my permission which, as my aunt bequeathed it to me, I will never give. As a consequence my cousin is allowing the house to fall into great disrepair and neglect. Do I have any rights to protect my future property as it deteriorates?

Re: real estate inheritance

Hi

Many thanks for your query.

A life estate gives the Life Tenant the right to live in, use and enjoy property during his lifetime.

A life estate can be created by a deed or will. It is important to review and consider the deed or will to ascertain the precise rights and obligations applicable to the Life Tenant and Remainderman.

During his time, neither the life tenant nor any person that he has transferred interest in the property to, may damage or devalue the property.

I trust the foregoing sheds some light on the issues raised. Please note this email should not be relied on as legal advice. I fully disclaim any liability for such reliance. You should discuss the matter with me further to obtain proper legal advice. Please do not hesitate to contact me.
