Tourist Visa Revoked, is marriage to a US citizen possible?
Hello,
My girlfriend is an Israeli citizen who entered the United States from Israel this past weekend. She was returning back to America after being gone about one month, so that she could visit her family and renew her tourist Visa for another 6 months. Once in the United States she was interrogated at customs and they went through all of her belongings. They found that she had done some baby sitting while in the United States about a month prior while she was in America. After finding this they made her leave the country immediately becasue this violated the terms of her tourist visa. My questions is whether I could go to Israel and propose marriage to her, as I had intended to to this some time in the near future? Does a revoked tourist visa make it difficult for her now to come back to America even as my wife?

It sounds like your girlfriend was subject to expedited removal, which means she would be barred from retuning to the US for 5 years, unless she receives a waiver. Her ability to ever get another vistors visa in the forseeable future is almost nil. Even if you marry her, she still faces major hurdles. Assuming she was deported in an expedted removal proceeding, she won't be able to return for 5 years unless a waiver is granted. She may have fraud problems because she claimed she was coming to visit and BCBP (Immigration) found out she was working which would mean she might need a 2nd waiver for fraud. If you are prepared to go to the mat for her no matter the cost and the time, then marry her. However, I can tell you, it won't be easy or quick getting her back.
