Legal Question in International Law in Italy

European Convention of Human Rights & Hunting

I live and work from my property in Italy. Under Italian law licenced hunters have the right to enter my land (although I am not entitled to request proof of licence).

My partner was assaulted by a hunter 4 years ago on our land.

We have just been refused an application (based on economic impacts . bed & breakfast) to have our land declared exempt from hunting.

I would like to ask whether I can use Article 8. of the European Convention on Human Rights to insist that my property remain private and use it to refuse this 'right to roam' by hunters?

Re: European Convention of Human Rights & Hunting

Dear Sir/Madam

Basically the problem is that to run a B&B the land has to be classified as agricultural.

I suggest you can solve the problem putting in your land some animals that are not allowed to hunt, to obtain a protected area from the Guardie Forestali.
