Italian probate inheritance
Hello,
My father, an Italian citizen, died in Italy 2 years ago. We are still sorting through the probate process, as he had no will. I have gotten involved with a very poor attorney. My question is: when the deceased (in this case, my father) has property that he inherited from his parents, does that go 100% to the children in the case of a second marriage? I know that the rest of the estate is divided 50/50 between my stepmother and I (I am the only child).

Are you talking about probate in Italy? If so, Italian law controls and you will have to rely upon your lawyer in Italy for the answer. Here the answer would be that the source of the property owned by your father at the time of his death would be irrelevant and all his property would be split between his wife and his children.
