Legal Question in Military Law in Japan

Oth

I was in the Marine Corps for 3 1/2 years. I was overseas in Okinawa, JP and was seperated for pattern of misconduct. Yet my commanding officer maxed me out over a MOR for leaving base drunk, when PMO knew that I was incohereant at the time. Then they still let me leave base with a 12am curfew. I left base 5 min. prior to 12am. They should not have let me leave base by procedure, but they did not care. I ended up passing out and breaking curfew. The commanding officer maxed me out at NJP and recommended Administrative Seperation over the MOR (Minor Offensive Report) that was given to me the next day that I came back to base.I have never had a page 11, nor any counseling sheets, always a high pft, and in a little . I was then discharged with an OTH and a RE-4 re-enlistment code. I am wondering how hard it will be to go before a discharge review board and get everything upgraded as much as I can.

Re: Oth

You would be applying to the Navy Discharge Review Board. It can be difficult.
