Legal Question in Workers Comp in Kansas

Can I change jobs if I have a workmans comp case open

I have had two surgeries on a disk in my neck. My doctor released me but I am still having problems. A second doctor stated I need more treatment. Can I keep the workmans comp case open and change jobs, or do I have to stay at the job I was injured until all treament is final.

This response does not create an attorney/client relationship nor is it legal advise.

You can change jobs and still keep a Kansas workers compensation claim open. However, the insurance company will probably try to prove that continued problems are caused by your new job rather than your original injury.

There are certain deadlines you must meet to keep your claim open. You must serve a written claim on your employer within 200 days from the last payment of benefits or providing of authorized medical care or your claim will be barred. You also must have an application for hearing on file within 3 years after the date of your accident or 2 years from the last payment of benefits or furnishing of authorized medical treatment or your claim will be barred.

I hope this information has been helpful. If you need further information, please contact me. Jim Wright.
