Legal Question in Banking Law in Kansas

Bounced check going to court

I unintentionally bounced a check to a well known merchant. Their attorneys mailed me information for out of court settlement, but I was not able to provide the money at that time. It went to court and judgement was for the merchant for full amount including attorney and court fees. I made arragements with the attorneys to make a payment every month until it was paid off. Then my mother had a heart attack and I missed a payment date by 3 days. The issue has now gone back to court and I have been ordered to be there or a warrant will be issued for my arrest. I just need to know what information I need to have ready for court. I cannot afford to hire an attorney of my own and am frightened about what is going to happen. Would someone please advise what the worst case scenario would be for a situation such as this? I want to be prepared for the worst. Thank you.

Re: Bounced check going to court

Call the attorney and find out if they will accept payment on the original plan. If they will not you MUST MUST MUST appear and explain to the court the circumstances. The judge may allow you to get current even if the attorney will not. Bring letter from doctor or medical records to back up your story.
