Legal Question in Bankruptcy in Kansas
bankruptcy on finacial aid
We filed chptr 7 in 11/2000 in Ks. Which included student aid, we thought it was dischared on 3/2001 with the rest of the case. We erecieved a garnishment orderfor that on 1/25. What is the law?

Especially in Chapter 7 filings...student loans are nearly impossible to discharge...child support, maintenance/alimony, criminal resitition, taxes are also examples of nondischargeable debt; there must be a showing of extreme hardship to include discharge of student loans in BR-7. Check w/the attorney who handled your case; should you have used a 'self-help' method, and truly thought the court had discarged said obligation, you might contact the trustee or the court.
