Legal Question in Bankruptcy in Kansas
Co-debtor in Bankruptcy Chapter 7
My husband's former spouse filed Chapter 7 Bankruptcy in Feb. 2003. She has failed to inform us. My husband is a co-debtor on some of the accounts she claimed, including the home we live in. Will we lose our home due to her filing?

Re: Co-debtor in Bankruptcy Chapter 7
Your husband is a co-debtor on mortgage. Ex-spouse will no longer be liable for debt and your husband will be solely liable for the debt. The bank will look to your husband for payment of the debt. It is unlikely that the bank will take any other action. However, because one cannot depend on getting the facts straight on the internet, I recommend that you take your mortgage, divorce decree, and other documents to an attorney for a full legal review.
