Legal Question in Bankruptcy in Kansas
Can a divorce settlement be bankrupted?
I was recently divorced and ordered to pay my ex
$5500. I lost my job and now work part time for minimal wage. I have many bills including medical from a mental breakdown brought on from the divorce.
I kept the mobile home we lived in and he has now signed the deed over to me. I have two minor children and have no money to pay him or my bills.
Thank-you

Re: Can a divorce settlement be bankrupted?
If by bankrupted you mean discharged, it depends on what type of debts are being settled. If you are talking about debts incurred as part of a property settlement, then yes as long as the nonfiling spouse does not timely and successfully object to discharge in the bankruptcy case. If they are part of support or maintenance for a child or the spouse, then no.
