Legal Question in Bankruptcy in Kansas

Types of Filing bankruptcy

I have around 25,000 in debts. I would like to file bankruptcy and would like to know if I can legally file on all counts with the exception of my Truck payment and credit cards. They are all new and I would like to have them to help me re-establish credit. Most of my debts are medical.

Re: Types of Filing bankruptcy

Basic criteria for filing BR is whether liabilities outweigh assets. . .u did not mention income available. . .assuming u meet this critera, u may file a Chapter 7 or 13; KS utilizes it's own 'exemptions', not the Federal; those exemptions include a vehicle per person, homestead, household items, etc.; you may reaffirm the debt on your vehicle to the institution, thereby exempting it from the BR. . .assuming u meet the other criteria. Hope this helps.

Re: Types of Filing bankruptcy

When you file bankruptcy you have to list all of your debts, however you can reaffirm on one or more of them during or after bankruptcy. You can choose between Chapter 7 - which liquidates all your assets and debts except for a fairly large number of exemptions, or Chapter 13 (wage earner) where you keep the assets you want and propose a plan to pay your creditors over time. Consult with a local bankruptcy attorney for more information.
