Legal Question in Business Law in Kansas
a business partner has a suit against the other two partners for a complete audit of books. His title in the LLC is treasure, shouldn't he have been overseeing those books. And can he be removed from the premises as long as the suit is in effect?

If suit has been filed, a party with an interest in an LLC can request an audit of the books. This is a separate issue as to whether the treasurer was doing his duty as treasurer. If you are being sued by this individual, you have a right to counterclaim if he was negligent. As to rights in the premises, I would need more information as to who owns said property and the rights of the parties under your operating agreement. Feel free to contact me if you want to discuss this further.
