Legal Question in Business Law in Kansas

lawer behavior

I recently found an attrny to represent me with a case. I have not officially hired him but I did receive a bill today in the amount of 7,500. The lawyer is from Kanasas and would like 5000 applied to the retainer. I spoke with another lawyer from my hometown and he said this is not acceptable in Kansas law. Is this true? Should I owe him anything?

If you haven't signed a letter of agreement or a contract for the attorney's representation, this is a point in your favor. If the attorney hasn't yet done any actual work for you, then, clearly, you don't owe the attorney any money. Retainer fees are usually taken as a means of guaranteeing payment of legal fees. You pay the attorney a sum of money and the attorney then works against that sum by doing work on your case and billing against the sum by whatever his/her hourly rate and expenses might be. The bill probably is merely to remind you of the required retainer amount. If you are in litigation or other risky or complicated matters, then this amount is not at all surprising. You can always find someone else, if you have time.
