Legal Question in Civil Rights Law in Kansas

I was arrested in Sedgwick Co., for a Traffic Fine in Saline Co, KS. I was incarcerated for 2 days and transported to Saline Co., by Salina Co. Sheriff officer. The warrant issued listed 3 choices at the bottom: Extradite; Extradite, Surrounding State only; Do Not Extradite--this was the choice marked. I was incarcerated in Saline Co jail for 2 days. At 5:00 pm on the 2nd day I was released, without going to court. When I questioned the Sheriff officer, I asked if I wanted to go? I said yes and was told to shut up and go or I'd be arrested for Disorderly Conduct. The following day, I went to the Saline Co. Attorney's office and told them I had paid the fine March 16, 2010 and today was July 29. 2010. They agreed I had paid it but they were not notified, by the County Clerk until the 28th of July, 2010. They were sorry and there was nothing they could or would do. The Assisant County Attorney left me standing in the lobby and walked off. What are my options? I have the original receipts and other paper work.

You may be able to sue in civil court for an unlawful arrest and incarceration. However, you may find the probable award is so small, that it will make it dificult to find an attorney willing to take the case on a contingent fee basis. You may have to pay them hourly, or by lump sum.
