Legal Question in Civil Rights Law in Kansas
If a man is hired for a position within a company because him and the HR person that hired him golf together, and two other ladies were passed over (one is 20 and right out of college and the other (Hispanic) has 10 years with the company in the department that they are hiring for) is this a violation of Title VII based on gender or race?
1 Answer from Attorneys
Perhaps. But, a person isn't guaranteed to get every position they apply fir, just because threat are female or hispanic. If one of the ladies files.a complaint, or discrimination law suit, they would have to prove a lot of facts beyond the race and gender of the applicants. These you're of single incident cases are very fact dependent. But, if the company had a pattern of refusing to hue women or Hispanics, the case may be easier to make. You might consult fitfully with an employment lawyer, in your area. Perhaps there Ste important facts that you weren't able to provide here.
Good luck
