Legal Question in Construction Law in Kansas

I live in Kansas. We paid a contractor for tile work in our home. He was paid in full. The sub-contractor, who actually performed the work, now says he was never paid by the contractor. He has threatened to put a mechanics lien on our home. Does the fact that we paid the bill in full to the contractor provide us any protection?

No. The sub will have to sue you to enforce the lien. In that suit, you can bring in the general contractor (and his bonding company) to pay you for anything the Court decides that you outer the subcontractor. The sub will probably file a foreclosure action to enforce three lien, do keep track if the generals business our whereabouts. You might be able to make a bond claim now. If you don't know who the bonding company is, contact your city or county. They should have that information.,
