Legal Question in Consumer Law in Kansas
getting my $500 down payment back
bought a car the middle of May. Put $500 down, they cashed the check May 19th. had the car for 3 weeks, was asked to come back in and was there 5hrs, during that time they told me I couldnt keep the car, about closing time they pulled another car up, said this is what I could get and it was the only one. signed papers drove it home, hated it. closed Sunday, called Monday morning and told them I didnt want the car and wanted to bring it back. They said no. Went to another KIA dealership,got approved and put back in the model of !st car. Took the other car back to KIA the same day. called finance company and said I didnt want that car but the one from Shawnee missin KIA and would be making payments on that one. They said it wouldnt be a problem because they had not funded the one form Olathe yet. Olathe KIA refuses to return my $500. said they will use it as depreciation and said they have to sell the car I didnt want as used,which later they denied saying that. The general mgr was rude and hung up on me, my salesman from Olathe that was involved in the first 2 cars appologized and said it wasnt my fault, said it should of never happened and he knew I didnt like the car they put me in after taking the other one back. can I get my $?

It sounds like you may have to take Olathe Kia to small claims court or start a limited actions suit.
