Legal Question in Consumer Law in Kansas

Dishwasher

I purchased a dishwasher over the internet, when delivered I noticed it was damaged on May 12, 2006. I have contacted this company three times trying to have this thing picked up without success. I just received a notice of payment due one year after this started. I have sent a certified letter notifying them that at the end of May I will start charging a storage fee if it is not picked up. If they don't pick it up can I dispose of it? Thanks so much. Kenison

Re: Dishwasher

Depending upon the circumstances of the sale and delivery, you may be able to discard the dishwasher without owing the seller for it. However, if you requested aand accepted financing from an entity ther than the seller, you ay owe them for the borrowed funds, and can sue the seller for breach of the sales contract.

These determinations require more facts then you were able to provide here. You should contact an attorney in your area, who can examine the documents for you.
