Legal Question in Consumer Law in Kansas

Do Lemon Laws Apply to Private Individual Sales?

We bought a jet ski from a person recently. When we took it out to ride it, we found it was not working properly. The person we bought it from indicated everything was in tip top shape. However upon a diagonostic check at a jet ski dealer we found the jet ski has a hole in a piston. The person who sold it to us does not want to do anything about it. The person is now saying she sold it ''As Is'' to us but never stated this to us or wrote it on anything.Do we have any rights under a Lemon Law?

Re: Do Lemon Laws Apply to Private Individual Sales?

I am unaware o fany "Lemon Law" that would apply to your situation. If you feel that the seller warranted that the condition of the PWC was free of the defect you found, then you should sue them in the civil court of the District where you purchased the WPC, or where the seller lives.

You did not indicate how much you paid. The Court Clerks may be able to tell you whether your suit may be brought as a small claims action. They are not expensive to do, and will provide you with your chance to tell your side to a Judge, who may be able to make you whole.

Good Luck
