Legal Question in Consumer Law in Kansas
Returning/Collecting Deposit
I own a furniture business. I collected $2700 for a $5400 sectional sofa. The client refused delivery upon receipt stating it was the wrong shape. I have tried to work out by offering to order additional pieces at my cost to provide what was wanted. She does not wish to work out. Am I responsible for returning the deposit? Is the remaining balance collectable?

Re: Returning/Collecting Deposit
Your question cannot be answered with more than "maybe" given the amount of information you were able to provide here. If there was awritten sales agreement, it may affect the deposit refund question. It seems that you have made offers to accomodate the customer's specific wants. but, if delivery was not accepted, you may not be able to collect the remainder of sale amount. If you had to special order any of the furniture, you may be able to collect some.
Good Luck
