Legal Question in Consumer Law in Kansas
my tire repair shop fixed a flat the end of july, last night while driving on the freeway, said tire flew off. Vehicle was damaged as well as wheel, tire appears to be okay. Is the tire repair shop liable?
1 Answer from Attorneys
The question is, was your shop negligent in the repair? The plaintiff (car owner) woudl have to prove that your shop was somehow ngligent in repairing the wheel. The easy assumption in these cases is tthat the lug nuts were nto tightened enough to make the car road worthy. Since the wheel came of a month after the repair, it seems like a tough case for the plaintiff to prove. If the car was not driven much between the repair and when the wheel came off, then the case is easier. Without more information, it is impossible to predict your likely liability with any certainty. If you are still concerned, you should consult direclty with an attorney in your area.
