Legal Question in Credit and Debt Law in Kansas
bad check
in december of 2002 I wrote a check at a local liqour store, we forgot to make our regualr deposit, the check was returned, the liqour store eletronicaly debited my account the proper amount as well as a 30.00 fee the very next day, however I went in today only to be horrified to find that they still have my orginal check although it is stamped paid, they are displaying it as a worthless check. Do I not get my check back, likewise is it legal for them to display this check for all to see. I am horrified, this matter was taken care of immediatley and the clerk refused to take it down nor call a manager to even ask it I could have it back give me my check back or take it down before the matter could be resolved. I called and the clerk told me he had no idea who their check service is. I am no longer satisfied with just getting the check back, they have never attempted to contact me and like I said they have been hanging on to this check and displaying it with all of my checking account information, address and dl number for all to see for almost a year. What can I do?

Re: bad check
Yours is an old situation, with amodern twist. In this case, you should hire an attorney to write a letter to the liquor store owner, stating that you have noticed they are displaying your private financial information without your explicit permission, and that you will hol;d them civially responsible for all identification forgeirs you suffer from teh date of reciept of the letter. That will probably get teh check down, or at least get them to blacken out your private information. An attorney should do this for anominal fee.
You could also write the letter yourself, but you may not get the same result.
Good Luck,
