Legal Question in Credit and Debt Law in Kansas
I bought a car in 2005 and finance thru Wells Fargo...due to financial reason, I had the car repoed with $8,000 left on the payment...now the a/c is being handled by a collection agency...can they garnish my wages because of this...and what right does the collection agency have, because when my wife was talking to someone there, he treated my wife with rudeness (raised his voice at her)...and my wife fired back at him...I live in Kansas...thank you very much for your help...

If yours was the only name on the loan, the collector should not be talking to your wife about it. Unless the obtain a judgment agaisnt you, they cannot garnish your wages. If they obtain a judgment, they can garnish your wages and execute against your bank account. this may include a joint account you hold with your wife. You may want to hire counsel to deal with this collector and creditor for you. It could save you money in the long run.
Good luck
