collection of promisary note from builder

We recently built a house. The builder was unable to complete several items on our house and agreed to pay a cash equivalent. He printed a note on his computer and signed it saying that he owed us $12,500. It has been months and no payment or action has been taken. Is this home generated paper with his signature binding? If so, how can we go about collecting the money?

The note is evidence of an agreement between you and the builder. Before one could conclude that it is a promissory note, one would have to see the note. One would also have to review the building contract and your history of adjustments as the house was being built. The note may be collectable. I think the situation is complex enough that you will need to hire an attorney to proceed. The amount in question exceeds small claims jurisdiction.
