Legal Question in Credit and Debt Law in Kansas

Employee no call no show and takes of with equipment

He is terminated for no call no show, but took off with company equipment and money that was given as a expense advance and per diem, I have forms signed that in the event of termination the company will take legal action, I was thinking of sending collection letters since we turned off the company cell phone he took off with, and the only thing I have is a address. Any suggestions?

Re: Employee no call no show and takes of with equipment

If you send the letters on company letterhead and in the name of the company, you may send letters demanding the return of the mo ney and eaquipment. You could even fiel suit.

But, if you do it in any other name, you are adebt collector, and must take the steps to be in accordance with the Fair Debt Collection Practices Act (FDCPA) Mess that up, and you could owe him more money than he owes you.

Good Luck
