Landlord vs. Tenet

Two years ago my boyfriend and I rented a house. We were evicted from the house because the landlord said we didn't pay rent even though we did buy by cash. Now he is trying to sue us for almost 4 thousand dollars for damages and unpaid rent. The only thing is that the damages in the house weren't done by us. We don't have any pictures of before the move in the prove it or any other kind of papers since it was two years ago. I want to know if we will go to jail if we don't pay the amount? Or what will happen since I am a full time student and he is the only one working?

We do not have debtor's prisons. You do not go to jail because you owe back rent. If you were to be prosecuted criminally for destruction of your landlord's property you might. But, it sounds like you are just being sued by your former landlord.

The landlord must make its case against you. Two years ago is also a long time for the landlord. They must show that damage was done, the cost and reasonableness of the repair, and that the damage was not normal wear and tear.
