Legal Question in Credit and Debt Law in Kansas
I was offered a settlement from HSBC in 2012. It took them 6 weeks to cash my check, which they ran through as an ACH debit as to not give me a copy of the check. Now they are saying the settlement is null and void and sold the debt to a collection company is this legal?

If there was an offer to settle, and you accepted, than the matter is settled. Hopefully, you kept your documentation. If a collector contacts you about the debt, let them know immediately (in writing) that the debt was settled. Your bank should have a record of the ACH, and you have your check book. If the collector doesn't back down, you need to consult directly with a creditor's rights attorney in your area.
