Legal Question in Criminal Law in Kansas
My 13 tear old son and a friend admitted to throwing a handfull of rocks at a semi and we thought we had it worked out and know the driver has decided that he is not going to turn it into insurance which would of been a thousand that know he wants to have us pay two thousand and if we dont he will push to charge my son with a felony
1 Answer from Attorneys
Ask the driver to provide documentation that his repairs will cost two thousand dollars. If he insisnts that he wants the money without providing any documentation, remind him that it may not be a felony for a thirteen year old to throw a rock, but it is for an adult to extort money from a thirteen year old. Also remind him that his failure to report this to his insurance, may cause him to lose his coverage, and maybe his job. If he can verify the amount of damages, perhaps you should pay it.
Good luck.
