Legal Question in Criminal Law in Kansas

Age Descrepinsy

i have a hadicapped brother-in-law who is ''28'' and who is adopted. i have been in this family for 10 years. until recently i had no reason to question his age. i came across a ''people search'' site that said he was ''42''. the question i have is where do these ''people search'' site draw their information from (financial institutions, loan cos. etc.) every one of these ''sites'' say he is ''42'' if he is only ''28'' then is there any laws being broken and if so what kind of laws. my mother-in-law is his legal guardian because he cannot take care of himself. i have 2 children that i do not want to get into trouble over their mother-in-law if she is doing something wrong.

Re: Age Descrepinsy

Sadly, the handicapped are among the most targeted groups for identity theft. It could be that someone who looks 42 now, used his identity to establish credit at some point. The people locator wources picked up on this lising and drew the date of birth that the thief used.

Or, it could be that he really is 42. Women lie about their age quite often. Generally it is not a crime. If you believe him to be 28, but he is really 42, it is not apparent to me that any law has been broken. A mother can be the care taker or guardian of a 42 year old son the same as a 28 year old son.

There does not appear to be any criminal danger to your children being around their grandmother. If she is breaking the law some how, or defrauding an agency to get benefits for her son, it would not be imputed to your children. If they knowingly lied to a government agency, they would be liable no mater what their grandmother does.

Good Luck
