Legal Question in Criminal Law in Kansas
My boyfriend gets out of prison in 30 days, he served 33 months and his plea agreement stated he would have 24 months post release. He got a letter in the mail yesterday saying there was illegal court sentencing and there is a motion for lifetime post release. How can they do this? Is a plea agreement a legal binding contract? He has no violent or aggravated crimes, how can they do this?

A plea agreement is between the Prosecution and defense. The city can adopt or reject the deal. If the Court accepts the deal, it sort of becomes the law for that case. This is an issue that he needs to raise with his attorney.
