if the cell phone isnt in your name can they press harassment charges on you or will they go after the person that the cell phone account is under

If harrasment occurred it is by the caller, not always the owner of the telphone. Many people have been convicted of acts they committed over a pay phone. But, if the phone is not in the caller's name, it can be dificult to prove who sent the incriminating calls or texts.
