I have been charged with Disorderly conduct. After having a problem with my 20 year old son. All this took place in my home when he tried to take a laptop computer, he then grab me by the throat and the police was call and he went to jail. I did not go to jail. Is there a law that allows me to protect my home and framily and friend that are inside my home? If so where would I find a copy of this law? Thank you for any help you give me.

Kansas recognizes self defense, the defense of others and defense of property as defenses to certain criminal offenses. The common law rule is set forth in case law such as State v Rutter, 252 Kan. 739 (1993). The rule is codified at Kansas Statutes Annotated 21-3211 through 21-3214. In short, you are privileged to use reasonable force to protect yourself, your guests, and your property. Feel free to contact me if I can be of further assistance.
