Legal Question in Criminal Law in Kansas
Citation for underage possession of alcohol
I got caught last night drunk and blew a 1.05 on the breathalyzer. I am an international student, 19 years old and the copper wrote me a citation to appear at a given day with $70 court costs. One thing that struck me as odd was that they took mugshots of me at the party from someone's camera. I would appreciate any advice as this is quite a threat to my future.
1 Answer from Attorneys
Get a lawyer. I would enter a not guilty plea and request a copy of the police report and any photos. If it appears that there is sufficient evidence to find you guilty beyond a reasonable doubt, then I would explore the possibility of diversion. Diversion is a type of probation in Kansas that, if successfully completed, will not result in a conviction on your record.
