Legal Question in Criminal Law in Kansas

dropping theft charges

I was arrested for stealing some plywood at a construction site, under $500. I admitted guilt and was issued a ticket to appear in court on possesion of stolen goods. I went to the construction site and talked the owner into not pressing charges. I cannot get through to the prosecutor, they wont talk to you till the court date. My question is: If I show up to court with a notorized letter from the owner saying he didnt want to press any charges and the issue has been worked out, will the judge throw out the case?? Thank You, Joe

Re: dropping theft charges

The alleged victim (the construction company) should contact the prosecutor and let him or her know that the company does not wish to follow through with the charges. You still need to appear in court regardless or could have additional problems.

No one can guarantee what the court or prosecutor will do. . .having the person there to advise the prosecutor and judge would be better, but you have the next best thing. Question would be, how official is the written statement you have? On letterhead of the company? Signed by someone of authority in that company?
