Legal Question in Criminal Law in Kansas

My ex-husband just went to prison for murdering his father. Does his parental right automatically get taken away or do I have to apply and go to court to have them taken away. He committed his crime in Ohio and the kids and I are in Kansas. Thanks

Conviction of a crime that did not involve his children, would not, in itself, be grounds for termination of parental rights in Kansas. I cannot speak as to Ohio law, but I suspect it may be similar. You did not indicate why you want to have the father;s rights terminated. Is there a step-father lookig to adopt? The question is, do you have to take the kids to Ohio to visit their Dad. That is a tougher question than as to termination You may want to consult directly with an attorney in your area, who can ask you many follow-up questions, and examine your Custody Order.
