Legal Question in Criminal Law in Kansas
Federal Sentencing
Is it legal to be sentenced in federal court while under the influence of a doctor prescribed mind altering drug? When I plead guilty to one count of mail fraud I was not under a doctors care, however, 4 months later upon my sentencing date I was. Does this make a difference at sentencing (I know it does when PLEADING!)? This case is in the Federal Court in Topeka KS.

Re: Federal Sentencing
I assume you had legal counsel present at sentencing? There are specific guidelines which the court follows at time of sentencing; the only question relevant would be whether those guidelines were followed. As you noted, your understanding of the nature and consequences of your plea together with your waiver of rights at your arraignment would be the focus prior to sentencing.
