Legal Question in Criminal Law in Kansas
Use of force
My brother was with a group of people, at a gas station and the police were called on them. They were standing outside of their vehicles and the police showed up. The police ordered everyone to put their hands up. My brother complide. He was standing there and one of the officers kicked him in the upper thigh he was thrown to the ground hand-cuffed and then kicked in the ribs and back. The police also beat him in the face and head with flashlights and fist. His face is still swollen and bruised and it has been over a week. My brother was arrested and charged with Assualt, Battery LEO X 2, Crim Damage and Dis Conduct. I took him to the police station to file a complaint and it turns out several different police departments are involved. We were told we had to file complaints in all city and county PD's involved and it would take several months for the investigation to get anywhere. We have contacted some attorneys but they will only deal with the criminal charges and want a lot of money. Do we have a civil case as well? And how can police get away with beating a man senseless and no one care about it?

Be patient and let the justice system do its job. . .file the appropriate complaints with each law enforcement agency involved. An attorney on board never hurts. . .make certain it is one who regularly works with criminal cases, however. This doesn't sound like the time to be economizing if your brother truly has a claim.
