Legal Question in Criminal Law in Kansas

What would happen if I got a 2nd MIP charge while I'm on unsupervised diversion? My first one was my first offense and it was an MIP and a Fake ID charge. I am 21 in a couple of months and am just wondering what would happen.

Technically, it would be a violation of your Diversion Agreement. The prosecutor in the previous cade would not be obligated to Dismiss that case. You likely admitted to the facts, in that case, so conviction would be likely.

The prosecutor, in the new case, would not likely agree to a Diversion. So, you'd have to try the case or make a plea agreement. Since you'd likely be 21 by then, the Court may agree to a probation, with a jail time back up.

I suggest that you not receive sk getting another MIP conviction. Complete your Diversion, and go into adulthood with a clear record. Otherwise, you might hurt your credit and security rating. These can cost you money and prevent you from getting some jobs.

If you've been charged with a new MIP, consult directly with an attorney very soon. You may contact me via email, if you'd like. Just mention this LawGuru posting
