Legal Question in Criminal Law in Kansas
Lawsuit against wichita p.D.
On April 28th, 2005 I messed up and drank 2- pints of vodka, after being sober for one and a half years. On that night I was in the midst of a blackout and was charged with DV Battery and booked in Sedgwick County Jail. Somewhere in that process the police department broke my pinky finger and it hurts. 1st question is: Can i sue? 2nd question is: Should I take the Deferred Judgement or take my chances with the plea of guilty. The Deferred Judgement Program has an alcohol evaluation tied into it and they decided I needed to attend their Outpatient Substance Abuse Program which forces me to attend and pay for 4 day a week for 8 weeks at $25 a shot treatment plus attended 16 AA meetings and attend an 8 week anger managemnet class. Total cost of around $1200.00. What should I do?

Re: Lawsuit against wichita p.D.
Your situation is far too complex to get an accurate "what should I do?" response. You need to discuss your pending criminal case with an attorney that has access to more of the facts than you have provided here. Contact one immediately. There are many fine defense attorneys in the Wichita area, most of which are listed in the phone book.
As to your potential claim against the Police Department, again, there is not enough information provided here to give you a useable answer. Perhaps the same attorney you see about yoru criminal matter can steer you to someone to evaluate your civil case prospects.
