Legal Question in Criminal Law in Kansas
I need to know how long someone can sit in jail before they get a court date. My husband was arrested on May 5th, 2010. Since then he has had 3 court dates, all of which he was still in jail for, his attorney has continued it 3 times. How long does he have to sit in jail before he gets a court date and/or goes to trial? I do not think he has even had a preliminary hearing yet.

If your husband has had three court dates, it cannot be said that he has not had an opportunity to go before ajudge, if his legal representiative asked the heraing(s) be continued. If yrou husband does nto understand why he has not had an opportunity to request bail, he shoudl ask his attorney. If your husband does not find the explanation satisfactory, he might consider getting new counsel.
Good luck
