Is probation an option
My husband is currently in custody in Johnson County on a failure to appear for a 2nd poss prior conviction for marijuna and theft $500. In Ks they consider the drug charge a felony. His public defender mentioned 32 mos for a sentence based on his past criminal hx which she says includes a burglary. Is is possible to go for probation or have this ran concurrent with another charge in Mo he is serving time for until Jun 7.

Yes, you can file a motion for a departure and to run this concurrent with the other matter. You need an attorney that will be aggressive on this.
