Legal Question in Criminal Law in Kansas
Probation to another state
My adoptive son is on probation in Anthony, Kansas. I live in Bountiful, Utah. I bailed him out of jail. He is charged and I quote from the district court of Harper County: ''feloniously and intentionally possess a narcotic drug to-wit: methamphetamine...''
I believe he will receive probation. I would like to know how to write a letter to a judge to appeal to him to allow my adoptive son to come to my home in Bountiful, Utah. I want him here where I can get him some help.
Would you kindly tell me what to write to a judge?
Thank you

Re: Probation to another state
It is not up to the judge. It will actually be up to Court Services in Kansas and up to Utah as to whether Utah will accept the supervision of his probation or not.
I would just write them a letter and explain to them you can provide him with the help and supervision he needs. He will also most likely be required to go into mandatory under SB123. This may be an in patient program. And that depends on his drug evaluation he will be required to get. As for probation, this really depends on his criminal history. If he does have a history, he could spend some time in prison in Kansas.
I wish I had better news. If you want to retain counsel instead of court appointed, I would be glad to help as I travel all over Kansas. You can contact me by email at [email protected]
