Legal Question in Criminal Law in Kansas
I have been on probation for 4 yrs for a probation that only should have been a yr long bc I have had troubles paying off my fines can they send me to jail now?
1 Answer from Attorneys
Based upon the facts you described, it is possible that you could be ordered to serve your underlying sentence. If you can demonstrate that your limited finances is the major reason that you have not paid all you fines, the Judge may alter the sentence. If you have not gotten into trouble in those four years, you do not seem to be a repeat offender. Your attorney may be able to convince the Judge to give you community service in lieu of fines, terminate your case, or convert you to diversion.
Determining what is probable in your case requires more information. Therefore, I suggest that you consult directly with a traffic or criminal defense attorney in your area. Many offer a free or low cost initial consultation. Gather all your relevant documents and go see one.
Good luck
