Legal Question in Criminal Law in Kansas

I'm a parent of a 12 year old child who was caught stealing a $5 dollar necklace, the store said that he was to young to arrest, but he was prohibited to go in there store for 4,years.
we had to go to the police station because his cousin was also caught who was 14 and when we got there, my son was booked and charged. they told us that we would get a letter from the court and we never have. But the cousin was served papers with a court date that is next week.
Is my son of age to be charged?

Legally yes, practically probably not. He certainly could be dealt with in the juvenile justice system. You did not say which city or county you are in. That could determine the likelihood that he will be prosecuted.
