Legal Question in Criminal Law in Kansas

Can you tell me how the WOP (without prejedice) of charges works. I have been told that it will hover over a persons head for 5 yrs and at the discretion of the court can at any time in those 5 yrs be brought up and charged again. What about speedy trial? Will it come up on a background check? How does one get that taken off their name?

Your case is dismissed. However, the prosecutor can refile the charges at anytime before the statute of limitations runs out. It should not show up on a check. If it does, you need to file a petition to expunge the arrest recorder.
