If i was pulled over for a headlight out and given a dui, would i have gotten the ticket if i had thrown my keys out of the window ,therefor not driving when he walked up to my car?

You probably would have still gotten the ticket, if the officer observed you driving while the headlight was out. The lck of keys is ususualy ponly applicable where the officer approaches the defendant in a parked car. If he pulls you over, your only oportunity to use the "I wasn't driving" excuse is if your passenger makes you change seats at gunpoint.
