Legal Question in Family Law in Kansas

I have a 6 year old daughter and her "father" has not been in her life since we split up close to 4 years ago. My boyfriend/fiance stepped up 4 years ago and he is who she knows as daddy. She has no memory of my ex. During the 2 years I was with my ex he was extremely abusive both verbally and physically. I want his rights terminated. Hes never paid child support (which I DONT want anyways) and neither myself or daughter have spoken to him n 4 yrs. I live in KS. Can i terminate his rights? I assume if I start the process he will be contacted. i suspect he will fight it just to fight it.

In most cases, courts will not terminate a parent's rights, when the child isn't in state custody, unless it is part of an adoption petition. Perhaps, after you're married, your husband will want to adopt her. You obviously do not have a good relationship with the father. Therefore, you should consult directly with a family law attorney, prior to doing anything. If you act wrong, you could lose custody and be paying child support to the man you don't like for the next 12 years.
