Legal Question in Family Law in Kansas
My abusive, belligerent husband keeps threatening to seize complete control of the finances. He has been shuffling debt for twenty-five years, and now is raving because I have been working to resolve the finances. He is in a rage because I paid the mortgage and utility bills on time, so now he says he is going to close the checking account. (He considers $40 a mo. on lottery tickets and $40-60 a mo. on text messaging to be legitimate because he has the salary.) I have not worked since our marriage so I have no funds. My question is would the law not compel him to support me until I can earn a living? My understanding is that I am entitled to half of everything he earns. Since we are nearly bankrupt, is it impossible to divorce? He makes a good salary but the debt has completely crippled us. Thank you for your answer.

Your question is quite complex, in that it concerns the issues of abuse, division of property, spousal maintenance and potentially bankruptcy. If you have been dependent on your husband, it is likely you would be awarded spousal maintennance, but not one-half of his earnings. Contact an experienced family law attorney.
