Legal Question in Family Law in Kansas
Affair and Justice
My wife had an affair with a coworker (I have the proof-phone text messages, underwear evidence, hotel encounter, etc...). We had just bought a huge house and she used my $7550.00 (inherited) for closing costs and then my world was turned upside down. She filed for divorce, kicked me out of the house after living there for 5 days and now has residential custody of my 2 young daughters. I found out about the affair right around the time she filed, and the kicker is that the guy lives about 8 houses down. We were married 11 years, have 2 daughters, and I am now living with my sister and things are ok with the custody, but my question today is:--name removed--I have any right to go after this guy even though Kansas is a no-fault state, with suffering or mental anguish, etc....? My daughter did say she was hurt by him while jumping on the trampoline, (a far fetched plee) but another thing is that I want him to stay away from my kids.--name removed--I have any rights for justice here?
I have so many other questions, but will send those in later. Thanks!

Re: Affair and Justice
As a no-fault divorce state, Kansas limits the use of the kind of evidence you describe. However, your question contains information that should be brought to the court's attention, especially your non-marital inheritance. You should consult an experienced family law attorney. We are here to help.
